Check a privacy opt-out after closing a financial account

Under the CFPB privacy rule, an opt-out continues after a customer relationship ends for information collected during or related to that relationship. It lasts until revoked through the permitted process. A later new relationship is a separate question: the old election does not automatically apply to it.

Separate the former relationship from the new one

  1. Locate the earlier privacy notice and any opt-out confirmation. Note the relationship and choice it covered, keeping account details private.
  2. Check whether the latest mailing concerns the former relationship, a new account or optional advertising. Do not classify it from the envelope alone.
  3. Use the institution’s verified contact to ask whether the old election remains recorded and what information it covers. A closed account does not prove all retained information was deleted.
  4. If you have a new customer relationship, read its current privacy notice and available choices. Submit a new election when appropriate instead of assuming the earlier one carried over.

Retention and marketing are different questions

The rule addresses the continuing effect of the covered privacy opt-out. It does not promise that closing an account deletes records, ends every legal notice or prevents advertising from other sources. Preserve statements, tax documents and notices you still need.

If you cannot tell why a former provider contacted you, ask its purpose through a trusted channel. Keep this information-sharing inquiry separate from a request to investigate an unfamiliar charge or account.

File the answer under the correct relationship

Keep former and current confirmations separately. Record any change you authorize so you do not accidentally revoke a preference or treat an old confirmation as a new one.
